Overview

Existing Buildings
Existing buildings, meaning buildings that were built in accordance to code at the time of
construction, typically merit extra consideration in a current updated code.
(2) Existing buildings. The following specified requirements shall apply to existing buildings which, for any reason, do not conform to the requirements of this chapter for new buildings.
(a) Major alterations and repairs. If alterations or repairs in excess of 50 percent of the value of an existing building are made to such building within a period of 12 months, the entire building shall be made to conform with the requirements given herein for new buildings; provided, however, that any existing building which, for any reason, requires repairs at any one time in excess of 50 percent of the value thereof, not deducting from such value any loss caused by fire or any other reason, shall be made to conform to the requirements of this chapter for new buildings, or shall be entirely demolished. The value of a building shall be determined by taking its assessed valuation and dividing by the ratio of assessed value to the recommended value as shown on the last preceding report by the State Supervisor of Assessments.
(b) Minor alterations and repairs. Every alteration or repair to any structural part or portion of an existing building shall, when deemed necessary in the opinion of the Building Inspector, be made to conform to the requirements of this chapter for new buildings. Minor alterations, repairs and changes not covered by paragraphs (a) and (b), may be made with the same materials of which the building is constructed, provided that not more than 25 percent of the roof covering of any building shall be replaced in any period of 12 months unless the entire roof covering is made to conform with the requirements of this chapter for new buildings.
(c) Changed use. If the existing use or occupancy of an existing building is changed to a use or occupancy which would be permitted in a similar building hereafter erected, the entire building shall be made to conform with the requirements given herein for new buildings provided, however, that if the use or occupancy of only a portion or portions of any existing building is changed, only such portion or portions of the building need be made to comply with such requirements, and further that the Building Inspector may approve any change in the use or occupancy of any existing building even though such building is not made to fully conform to the requirements of this chapter when it is obvious that such a change in the use or occupancy of the existing building will not extend or increase any nonconformity or hazard of the building.
(d) Maintenance. The requirements contained in this chapter covering the maintenance of buildings shall apply to all buildings and structures now existing or hereafter erected. All buildings or structures, and all parts thereof, shall be maintained in a safe condition and all devices or safeguards which are required by this chapter at the erection, alteration or repair of any building shall be maintained in good working order.
(e) Removal or non-maintenance. The provisions herein shall not be construed as permitting the removal or non-maintenance of any existing devices or safeguards unless authorized in writing by the Building Inspector.

18.12 – AUTOMATIC FIRE SPRINKLER PROTECTION.
(2) Installation required. An automatic fire sprinkler system shall be installed in all structures where the floor area exceeds the thresholds established in Table 18.12(2) of the specific occupancy involved. For the purpose of determining square footage as it relates to the sprinklering of a building, firewalls shall not be considered area dividers unless the firewall is built in compliance with Section 705 of the CBC.
